A father was so enraged about not being sold a car, he shattered a man’s leg, shocking CCTV footage reveals.

Scott Nathan Kennedy, 35, was jailed for his “appalling” conduct after he left the victim requiring four surgeries and with a permanent limp.

During sentencing, the District Court heard the victim’s wife was selling her silver Mitsubishi ASX in August 2022.

Kennedy attended the victim’s Munno Para address to test drive the car and his wife contacted the victim’s wife in October to pay a deposit.

“By this time the seller had changed her mind and intended to sell the vehicle to a family member, although this was not conveyed to you or your wife at that time,” Judge Anthony Allen said.

Kennedy went to the victim’s home on October 9, 2022 to discuss the sale of the car.

After the victim told Kennedy that the car was to be sold to a family member, he became aggressive, telling them he had already bought them a thankyou present.

The court heard Kennedy armed himself with the handle of the car’s jack and demanded the victim sell him the car.

“You followed him up the driveway and swung the metal pole towards his legs,” Judge Anthony Allen said.

The court heard Kennedy then struck the victim again to his legs, with the third time causing the victim to fall to the ground.

“It is apparent from that footage that on the third swing the victim’s leg was instantly shattered,” Judge Allen said.

The tibia and fibula of the victim’s right leg were broken into multiple fragments causing bone to protrude out of the skin and he required four surgeries to correct the damage.

The court heard the victim had been unable to return to work, resulting in financial stress and now walks with a permanent limp.

Kennedy, of Redwood Park, pleaded guilty to serious causing harm with intent.

The court heard Kennedy was deeply regretful for his actions and had taken significant steps in his rehabilitation.

Judge Allen sentenced Kennedy to three years and eight months jail, with a non-parole period of one year and 10 months.

“Whilst you may have been disappointed with not being able to purchase the car, that is no excuse for the total loss of self-control exhibited,” he said.

“The fact that you swung a weapon three times at the victim’s legs, without provocation, on his own property, is appalling conduct.”
