A father who abused his own son and attacked a police officer has asked a judge not to confiscate his gaming computer – and her response is one for the ages.

A violent pedophile who assaulted a police officer has begged a court not to confiscate his gaming computer – leading a judge to remark it will be “out of date” by the time he is paroled.

In the District Court this week, counsel for the man – who cannot be named, as his victim is his own son – made one last bid for clemency on his behalf.

Jason Evitts, for the man, said his client had a strong “sentimental” attachment to his computer and wanted it back, even though it was used during his offending.

“(Taking it away) would be an additional punishment rather than a deterrent (not to reoffend),” he said.

“If he were able to retain his gaming modules and the games that he modified, then he has something to focus on upon his release from custody.”

Judge Liesl Kudelka – who has yet to sentence the man – was unmoved.

“I suspect that, when he’s released from custody, those gaming modules will be somewhat out of date, Mr Evitts,” she said.

The man, 26, pleaded guilty to 20 child abuse offences against his son including unlawful sexual intercourse, and to assaulting a police officer.

Previously, the court heard he used his feet and legs to kick and crush a detective from the elite Joint Anti Child Exploitation Team into a car window following his arrest.

The car was moving at the time, and in the middle of heavy Kensington Rd traffic – though backup was called, the detective suffered injuries that have left him permanently disabled.

“His attack upon me was totally unprovoked, unnecessarily prolonged, excessive and violent,” the detective said in his victim impact statement.

“I will never forget the expression of total rage in his eyes as he repeatedly kicked me … the odour of his sock, pressed against my face and nose, has not and never will leave me.”

During this week’s hearing, Mr Evitts tendered an apology written on his client’s behalf, but said neither he nor the man himself were its author.

“I can say with full candour that that letter has not been authored by my client,” he said.

“He had a cellmate use, as he described them, ‘more complex words’ that he could not put down in writing.”

Prosecutors said they maintained their request the gaming computer be confiscated, arguing the law specified forfeiture was designed to “punish offenders” who misuse technology.

Judge Kudelka agreed, and remanded the man in custody for sentencing in two weeks.
