Prosecutors drop charges against former immigration detainee Aliyawar Yawari

A convicted sex offender who was arrested following his release from immigration detention has had a huge win in court.

A convicted sex offender who was rearrested following his release from immigration detention last year no longer stands accused of indecently assaulting a woman in a northern suburbs motel.

Former immigration detainee Aliyawar Yawari was the first person released from detention by a High Court decision in November last year to be rearrested for criminal offending.

The Advertiser revealed Yawari had an history of sex offending before being held in detention, but was allowed to live in the community before he was rearrested in December.

Yawari, who was held in detention in Perth, had been charged with two counts of indecently assaulting a woman at the Pavlos Motel in Pooraka following his release.

Police had alleged they were called to the motel at about 10pm on December 2 last year following reports a woman had been indecently assaulted.

The alleged victim had told police that she had experienced trouble accessing her hotel room when Yawari offered to assist her.

“The victim states that at about 9.30pm, she was sitting outside her room on the outdoor chair. The accused asked if she would like a massage, which she consented to, and she proceeded to lie on her back on the bed in his room,” police alleged.

The victim told police Yawari began rubbing her legs for approximately two minutes, but then moved “both of his hands down the front of her pants and on top of her underwear”.

He then allegedly tried to rub under her underwear, when she told him “no”.

However, in a hearing in the Elizabeth Magistrates Court on April 4, prosecutors told the court they would not be pursuing the charges, and tendered no evidence.

Yawari is not the subject of any further charges and has no other files before the court.
