A teenage girl was allegedly sexually assaulted by a man in a booth at a CBD nightclub despite her continued protests, a court has heard.

Jacob Matthew Sumner, 25, of Evanston, is standing trial in the District Court this week after pleading not guilty to two counts of rape.

Katherine Draper, for the prosecution, told the court a 17-year-old girl attended the birthday party of one of her friends at Atlantis Lounge in February 2022.

Staff gave her a wristband identifying her as underage.

“The fun continued into the night, when a group of men joined them in their pre-booked booth,” Ms Draper said.

The court heard Mr Sumner and the alleged victim, who told him her age, shared a kiss before he pulled her onto his lap – all of which was consensual.

Ms Draper said Mr Sumner then began sexually assaulting the victim, who told him no.

“On the prosecution case the defendant didn’t listen. He became more dominant, he continued,” she said.

“He continued despite the complainant reiterating her lack of consent to the defendant on multiple occasions, again she said no, again he continued.

“On the prosecution case, no doubt confused, perhaps scared it got to the point where the complainant felt she had no other option but to acquiesce and wait until it was over.”

The court heard the alleged victim went to the bathroom after the alleged attack and realised there was blood smeared all over her white dress, alleged to have been wiped there by Mr Sumner.

The court heard the alleged victim told her friend about the alleged attack shortly after it happened and underwent a medical exam which revealed an abrasion on the entry into her vagina.

The court heard Mr Sumner was arrested and denied any sexual activity occurring with anyone that evening.

However, Ms Draper said CCTV footage showed Mr Sumner and the alleged victim kissing and his jeans had faint blood stains on them, which were a match to the alleged victim’s DNA.

Martin Anders, for Mr Sumner, said the key issue during the trial would be consent and the precise contact which happened between the parties.

The trial before a jury continues.
