Fraydon Azimi sentenced in District Court after pleading guilty to impregnating teen girl

A young man has been sentenced after getting a 14-year-old girl pregnant and keeping naked photos of her.

A young Elizabeth Downs man has been jailed after impregnating a 14-year-old girl he met on Snapchat.

Fraydon Azimi, 23, appeared in the District Court for sentencing earlier this month after communicating with his victim – whose Snapchat profile indicated she was aged 19 – over a three-month period in April, 2022.

Azimi pleaded guilty to unlawful sexual intercourse with a person under 17 years and one count of possessing child exploitation material.

Judge Michael Burnett acknowledged Azimi believed the girl was an adult, but noted he never made any direct inquiries as to how old she actually was during their communications.

“In April 2022, the victim added you on Snapchat and you began talking to her,” Judge Burnett said. “I accept that you met the victim online and her profile identified that she was 19 years of age and that you believed she was 19 years old.

“You then arranged to meet with each other for the first time at the beach. After that you and the victim continued to meet on a frequent basis. Between April 1 and August 31, 2022 you had sexual intercourse with the victim and she fell pregnant.

“After the victim became pregnant, she disclosed to you that she was 14. You then reduced your communication with the victim and only spoke to her to ask if she was going to have an abortion.”

The young girl gave birth in early 2023.

Around mid 2023, police seized Azimi’s phone and later conducted an analysis where they found ten images of child exploitation material.

The court heard the photos were of himself and the victim either naked – or semi naked – and included the victim dressed only in her underwear.

Judge Burnett noted “all the images” remained in Azimi’s possession even after he became aware of his victim’s true age.

“You continued to retain and possess those images,” he said. “You stated you were not aware that the photos and videos you took of the victim were illegal.

“I accept the offending occurred in the context of social naivety and the failure to completely understand and comprehend your social and legal responsibility.

“The victim fell pregnant as a result of your actions and has had a baby. A term of imprisonment is the only appropriate penalty. Because of her age, the victim was in a position of vulnerability and required protection.”

Judge Burnett sentenced Azimi to three years, one month and 14 days imprisonment with a non-parole period of one year and eight months.

The sentence was backdated to January 29, 2024 – when Azimi was remanded in custody.
