A fifth man charged with rape over the attack on two women in a Hindley St carpark was already on bail for similar charges, a court has heard.

A fifth man arrested and charged over an alleged gang rape on Hindley St at the weekend was awaiting trial for two other counts of rape in “not dissimilar” circumstances, a court has heard.

The latest man arrested, whose name is suppressed as the investigation continues, appeared in the Adelaide Magistrates Court on Friday charged with two counts of rape.

The court heard the 20-year-old Adelaide man will stand trial in the District Court next year on two counts of rape. He is also charged with breaching his bail.

The man’s lawyer said her client admitted being there and being filmed on security cameras.

However, the lawyer said her client denied being involved in the attack itself, and had instead walked in on the abuse and walked away.

A prosecutor rejected that claim, saying the man had admitted being at the parking garage between 9.30pm and 2.40am, during which the two victims were abused for half an hour.

The court heard that the man did not know the victim and the case against him was comparitively weak compared to the other men arrested.

Magistrate Melanie Burton rejected the man’s bail, citing the similarity of the offending pending in the District Court and the need to protect the victims.

He will appear in court again in March next year alongside the other accused.

The man is the fifth charged with taking part in the alleged Hindley St stairwell gang rape – and the sixth arrest overall arising from the incident.

He joins three other men – a 20-year-old of no fixed address, a 23-year-old of Kensington and a 21-year-old of Clearview – and a youth, 17, who have also been charged with two counts of engaging in sexual intercourse without consent.

The charges arise from an alleged incident in the early hours of Sunday morning in the stairwell of the Hotel Plaza car park.

Previously, prosecutors have alleged two women were gang-raped by seven men – some of whom committed sex acts, others of whom stood and watched – for half an hour.

It is further alleged one of the women managed to escape but went back to rescue her friend, only to be set upon a second time.

The 21-year-old is further accused of offering to pay one of the alleged victims $4000 to give false evidence about the incident.

A second youth, 17, is separately charged over that alleged attempt to induce a witness.
