Tiser Explains: How a criminal trial works

Fantasy bottles were left scattered by a bathtub after a drug dealing couple’s frantic attempt to get rid of evidence, court photos reveal.

Danielle Michelle Booth, 40, and Daniel Maxwell Heffernan, 37, were caught with tick lists, cash and large amounts of drugs during the police raid.

During the duo’s trial in April, the District Court heard police searched a property at Two Wells on February 2, 2020.

Booth and Heffernan were both present and there was a delay in answering the door.

The court heard police located 1.1kg of fantasy in the bathroom and 5.5kg of fantasy in a car parked out the front of the house.

In the bathroom there were a number of empty plastic bottles on the floor and fantasy in the bathtub.

The drugs located were worth more than $13,000.

James Meegan, for the prosecution, told the court that was because either Booth, Heffernan, or both of them, were trying to get rid of as much fantasy as possible before answering the door.

Police also located multiple mobile phones, funnels, $1845 in Booth’s handbag and $1000 on Heffernan.

Booth, of Salisbury Heights, and Heffernan, of Brahma Lodge, were found guilty of large commercial drug trafficking and commercial drug trafficking after the jury trial.

The couple are listed as in a relationship on Facebook.

During sentencing submissions last month, Mr Meegan said it was evident the duo were motivated to an extent by profit.

Chris Allen, for Heffernan, told the court his client didn’t accept the verdict.

Mr Allen said Heffernan had already served a significant time in custody for the offending and realised he was at a turning point in his life.

“He does have some future … the question is what he chooses to do when he’s released on parole,” he said.

“He is a common story in the sense that a relatively well functioning man who’s able to hold down employment obtains a drug addiction and his life goes off the edge of a cliff,” Judge Michael Durrant replied.

Carrie Demertzis, for Booth, asked for an adjournment to obtain a psychological report for her client.

Judge Durrant will sentence Heffernan next month.
