Chad Douglas McMillan tells court: ‘The worst stuff isn’t my kind of thing’

After months on the run, a sex offender – who’s already pleaded guilty – now claims police have the wrong idea about his gross collection.

A pervert who spent seven months on the run after pleading guilty now says the “worst” material on his computer was not his – and he will take the stand to prove it is “not my kind of thing”.

On Monday, Chad Douglas McMillan was due to face sentencing submissions, in the District Court, for producing and possessing child exploitation material.

However his lawyer, Aaron Fornarino, said his client had raised an issue while discussing the contents of his seized mobile phone and tablet device.

“Multiple images were recovered from them, and they are in the worst category of child exploitation material,” he said.

“He instructs that he never downloaded or had any knowledge of that material … in his own words, they were ‘not my kind of thing’.

“He does wish to give evidence about that, yes.”

In February last year, McMillan, 44, pleaded guilty to one count of possessing, and one count of producing, child exploitation material.

Instead of facing court a month later as scheduled, he fled to Cairns where, in October, he was arrested while carrying a hunting knife in his bag.

McMillan was then extradited back to SA.

On Monday, a prosecutor said the images about which McMillan was complaining were “uncharged offences” – in other words, they were not encompassed by his guilty pleas.

However, he said they were still relevant matters for the court to consider in sentencing.

“These multiple files had been deleted and were recovered forensically so, at law, McMillan cannot have been said to have possessed them at the time of his arrest,” he said.

“But the fact they have been deleted means that, at some point, they were on the device.”

McMillan was remanded in custody to face court again next month, when he will give evidence.
