Alleged Comanchero bikie Jye Benn Bone, 20, accused of cocaine use while on bail over alleged Morphett Vale assault with co-accused
An alleged bikie asking a magistrate to ease his bail conditions for work has hit a roadblock – with prosecutors raising a white-powder problem.
An alleged Comanchero bikie set to face trial after a brazen gang attack allegedly breached his bail conditions by “filling his nose up with Bolivian marching powder”, a court has heard.
Jye Benn Bone, 20, appeared in Adelaide Magistrates Court on Monday for an ongoing application to remove his home detention bail conditions – which would allow the full-time employee to continue working without having to obtain pass-outs.
But a “less formal” version of checking Mr Bone’s existing compliance with bail, prosecutor Mitchell Mott submitted, had returned a positive result to cocaine on November 27, and requested Magistrate Ben Sale order a home detention compliance report.
“That also might be able to address any concern over the pass-outs – which may be one of the main reasons for the application,” he said.
Defence counsel, for Mr Bone, of Hackham West, said she wasn’t opposed to a compliance report – but submitted prosecution’s concerns could be mitigated by her client being granted unsupervised bail “with drug testing”.
“Why would that make me have confidence that he could comply with less strict conditions of bail given he’s been using cocaine?” Mr Sale said.
“It might even give the impression that, well, there’s really no penalty. ‘Have a good time on home detention – fill your nose up with Bolivian marching powder and then ask your lawyer to reduce your restrictions and the court will wave you through’.
“It doesn’t necessarily feel like the right message to send a bailee.”
Last week, Mr Bone and his co-accused Kaani Maxwell Matthews and Pierre Georges were scheduled to enter their pleas.
Michael Woods, for Mr Georges, 27, said his client was not in court because he was going under the knife for a recent “boys’ problem”.
The court heard the Hackham man would “likely” plead not guilty and formally enter pleas in the New Year.
The men were arrested in June after a man was taken from outside a Huntfield Heights shopping centre in a silver 2017 Mitsubishi, driven around, and assaulted at Morphett Vale.
The court previously heard the victim, Hussein Al-Obaidy, suffered a broken jaw, three broken teeth, a broken nose and soreness to his throat from being choked.
According to court documents, it is alleged all three men assaulted Mr Al-Obaidy on June 3 at Morphett Vale and caused him harm. It is further alleged they took his phone.
Police previously alleged the ute was driven “erratically” and at high speeds along the Southern Expressway during the incident.
“The defendants drove him around before stating something similar to ‘we’ve got the wrong guy’, pulling over on Sports Park Dr at Morphett Vale,” prosecutors previously told a court.
All three men are charged with one count of aggravated causing harm with intent and one count of dishonestly dealing with property.
Last week, Mr Bone and 30-year-old Mr Matthews, of Port Noarlunga, stood together in the dock and pleaded not guilty.
They were remanded on continuing bail to be arraigned in March.
Mr Georges was remanded on bail to return to court in late January.
On Monday, Mr Sale ordered a compliance report for Mr Bone and remanded him on his current bail conditions to return to court later this month.
