A man could be freed from prison in less than three years after he filmed himself raping his girlfriend’s intoxicated mother in a shocking act of betrayal.
The 25-year-old man, who cannot be named to protect the identity of his victim, left his former partner “scarred for life” after she found the horrific videos on his phone.
During sentencing, the District Court heard the victim of the man’s offending was the mother of his former partner.
“Effectively your victim and her family took you in and treated you as one of their own,” Judge Anthony Allen said.
“Your betrayal of their love and affection is nothing short of appalling.”
Judge Allen sentenced the man to five years jail, with a non-parole period of three years.
The sentence was backdated to September 18.
The court heard the victim’s daughter searched the man’s phone after developing fears he was being unfaithful.
“The contents were shocking,” Judge Allen said.
The court heard the woman found multiple videos of the man indecently assaulting or raping her mother, who was a heavy drinker, while she appeared to be passed out on a massage table.
A victim impact statement was read to the court last month by the victim and her daughter.
The former partner said the thought of the man touching her after raping her mother makes her wish she could crawl out of her body and find a new one.
“I’m scarred for life after watching multiple videos of him violating my mother,” she said.
“No one should have to tell their mum that and I’ll never forget her screams and cries.”
The victim, through a prosecutor, said receiving the call from her daughter after she found the videos of her being raped broke her heart.
“He chose to rape a person who regularly showed him more generosity and love than his own family,” she said.
“I felt very violated, betrayed and ashamed by someone I let into my family and home as a son.
“Our family will never be the same again.”
The man pleaded guilty to rape and engaging in humiliating or degrading filming, relating to the offending between 2022 and 2023.
The court heard the man told his partner his motivation for the offending was to extract revenge after she disclosed some private information to him.
The court heard the man had previously held a role in a football club but was now unable to work in the same industries again due to his convictions.
Judge Allen said the man repaid the victim’s kindness by offending against her in circumstances where she was unable to protect herself.
“The fact that you filmed the offending against her is particularly degrading and humiliating,” he said.
