EXCLUSIVE: John Tomic says he has proof Lleyton Hewitt victimised his son while he was on Davis Cup duties and is adamant he will have his day in court to expose what really happened.

John Tomic claims to have evidence Lleyton Hewitt victimised his son Bernard during a Davis Cup tie in 2010.

Tomic senior told the Sunday Herald Sun via text message he can prove his claims in court.

“Evidences will prove,” he messaged.

Tomic has threatened to initiate legal action as Bernard insisted he still loves and respects Davis Cup - but will not make himself available while Hewitt is captain.

In the ugliest spat in Australian Davis Cup history, Bernard Tomic admits warning Hewitt he would knock him out “he ever came close or try to talk to me.”

“I love Davis Cup and respect it, but not while he is captain,” he said.

The latest exchange continues a bitter spat between the two former allies, revealing a deep-seated enmity.

Tomic last week accused Hewitt of being selfish, having conflicts of interest and treating some players more favourably than others.

The Wimbledon quarter-finalist said Hewitt had lost the support of Nick Kyrgios and Thanasi Kokkinakis.

Hewitt countered by calling Tomic a “clown”, while confirming he had been threatened by the Gold Coaster as well as “blackmailed” over Davis Cup.

John Tomic last year challenged the Herald Sun to “write about LH how he is in conflict with TA.”

“Write about LH….what he is doing in TA.

“You can’t (because) he will sue you.

“We got lawyer who will chase any wrongly condemns and writes what’s wrong.”

Hewitt will this week name his squad for Australia’s Davis Cup tie with Bosnia Herzegovina in Adelaide from February 1.

With Kyrgios and Kokkinakis under injury clouds and Tomic unavailable, the squad is certain to be led by Alex de Minaur and John Millman with Jordan Thompson, Matt Ebden, Alex Bolt, Alexei Popyrin and John Peers also in contention.

It is not certain if Hewitt will play doubles.
