The alleged driver of a buggy which rolled on a North Queensland beach, killing a 25 year old last year has been mentioned for the first time in court.

Rylie Anderson Crosbie had his case mentioned in Townsville Magistrates Court this week after it is alleged he was the driver of an unregistered ATV which crashed and killed Jacob Francis Ingles.

Phil Rennick from Rennick Lawyers, who is representing the 24 year old, mentioned his case on Friday and ordered a brief of evidence.

Magistrate Susan Warrington ordered that the brief be disclosed by August 29.

Castle Hill man Bruce Allan Butler is the owner of the ATV and was previously charged in relation to the incident and fronted court earlier in the year for allegedly permitting an uninsured vehicle to be driven on a road.

Toolakea beach is located 40 km north from Townsville and on the morning of August 16, it was the site of the tragic buggy crash.

Ms Ingles was a passenger in the vehicle when it rolled around 2:15am and despite the efforts of emergency services, he died at the scene.

Mr Crosbie and Mr Butler were taken to Townsville University Hospital with non-life threatening injuries.

The North Queensland community was rocked by the 25 year old’s death, with close friends describing him as a “kind and intelligent young man” who had recently graduated with his geology degree.

A police spokesman said they would like to remind the public in Queensland a UTV, quad bike and motorbike are all motor vehicles and are required to be registered if used on a road.

“In Queensland, a beach is a road,” he said.

“As a result, all road rules apply when a motor vehicle is driven on the beach, and you should never drink and drive.”

Mr Crosbie was charged last month with dangerous operation of a vehicle causing death or grievous bodily harm, driving an unregistered and uninsured vehicle on a road, and driving while over the middle alcohol limit

No pleas have been entered.

Mr Crosbie remains in custody.
