North Queensland man makes bail application in Townsville Magistrates Court after recent sexual assault sentence

A man recently sentenced for sexually assaulting his former partner has applied for bail while facing extra charges relating to the torment his ex. Here’s what happened.

A man facing extra domestic violence-related charges said to have occurred after he sexually assaulted the same partner as applied for bail.

The North Queensland man who cannot be named to protect the identity of the victim did not appear in person or via video link in Townsville Magistrates Court on Friday morning, instead was represented by his lawyer Murray Bower from Townsville Lawyers.

Police prosecutor Tasman Murphy provided background to the man’s most recent sentence, telling the court he was sentenced to six months jail suspended for nine months for sexual assault.

However, the man still remained in custody as his final charges, of contravening a domestic violence order, public nuisance, drink driving, failing to appear in court and contravening a release condition were yet to be dealt with.

Mr Bower said the man planned on entering pleas of guilty to all charges.

The prosecutor said the undealt with charges occurred after the sexual assault offence and included the man sending a series of messages to his ex which included, “you f--king c--t I will kill you, you pay the mortgage you can kiss my c-ck, you f--king dog c--t, I’ll throw you straight off the veranda”.

Additionally in separate offending Mr Murphy said the man yelled at people while he sat in his car along The Strand in hopes to instigate a fight and presented a blood alcohol reading of 0.090.

The man’s lawyer said the remaining charges could have been dealt with at the same time as the sexual assault in District Court and he could have been released from custody earlier.

“It would be my submission that had these offences been dealt with by His Honour in the District Court it would not have affected the outcome or sentence and indeed he would’ve been released on all of these charges,” Mr Bower said.

However, Magistrate Ken Taylor acknowledged the man’s history of failing to appear in court, and his pattern of reoffending in a domestic violence setting even after being sentenced.

“I have to take into account his risk of reoffending as well,” Magistrate Taylor said.

“I am yet to be satisfied about his risk of reoffending upon release and risk of failing to appear.”

His Honour refused the bail application and the man was remanded in custody, with the charges being adjourned to sentence on October 10 in Townsville Magistrates Court.
