Tobias Edward Kelly has bail revoked after racking up 44 charges

A 21-year-old who allegedly attempted to steal a vehicle at Pacific Pines during which a gel blaster was fired had a warrant out for his arrest and is facing dozens of charges stretching back months.

A 21-year-old who allegedly attempted to steal a vehicle at Pacific Pines on Anzac Day, during which a gel blaster being passed off as a real weapon was brandished at the vehicle’s owners, had a warrant out for his arrest and is facing at least 44 charges dating back a number of months, a court has heard.

Nerang man Tobias Edward Kelly appeared in Southport Magistrates Court on Monday, April 28 facing six new charges, three counts each of unlawful use of a motor vehicle and burglary.

Speaking to reporters prior to Mr Kelly’s court appearance, Superintendent Brett Jackson said it would be alleged Mr Kelly and a 15-year-old co-offender attended a residence at Taske Rise, Pacific Pines, at about 8am on April 25.

Police allege they attempted to steal a vehicle but were interrupted by the occupants, at which point one of the co-accused allegedly produced what the victims believed to be a gel blaster.

Superintendent Jackson said a shot was allegedly fired, but no projectile was discovered, corroborating the belief it was not an actual firearm that was being used.

The occupants were able to record the registration plates of the vehicle Mr Kelly and his co-accused allegedly attended the scene in.

Police investigations revealed it had been stolen earlier that morning from Robina.

Mr Kelly was subsequently arrested and remanded in custody.

He made a bail application before Magistrate Louisa Pink.

The court heard that, with the addition of the new charges, Mr Kelly currently has about 44 charges before the courts. He was on a warrant for failing to appear at the time of his April 25 arrest.

Defence lawyer Katie Grotherr from Legal Aid told the court her client was still very young and had been struggling with his mental health against the backdrop of a relationship breakdown.

She submitted Mr Kelly ought to be released on bail with conditions including that he have a curfew, submit to drug testing at Coomera Police Station, and continue to live with his father in Coomera.

Police opposed the bail application, telling the court Mr Kelly had been on an ongoing crime spree.

Ms Pink noted the new charges before the court were serious offences and said the evidence against Mr Kelly was strong.

“Mr Kelly, in my view there are no conditions that would sufficiently ameliorate the risk of you committing offences and you are an unacceptable risk of committing further offences,” Ms Pink said.

“In my view, this is not a case where you are at risk of spending too much time in custody.”

Bail was refused.

As she delivered her remarks, Mr Kelly became visibly upset, crying as he offered to submit an early plea.

“If you want to live in jail, you are going about life the way that you should,” Ms Pink said.

His charges will return to the court on May 20.
