Nicole Luttrell: Cheryl Kendall’s daughter sent $27K from Robinson Meats

The daughter of notorious Tasmanian fraudster Cheryl Kendall, who sent butcher Philip Robinson to the wall to feed her gambling addiction, will have to repay thousands, it can be revealed.

A Tasmanian woman who received $27,000 amid her mother’s $420,000 pillage of beloved butcher Philip ‘Robbo’ Robinson has undertaken to repay thousands, with a caveat placed on her property to secure the funds.

Following a second creditors meeting into doomed business P.J. Robinson Pty Ltd, which traded as Robinson Meats and Robbo’s Chicken & Meats prior to 56-year-old bookkeeper Cheryl Ann Kendall’s plunder to feed her gambling addiction, it can be revealed Kendall’s daughter Nicole Luttrell, a horse trainer in business with her racing identity father John, will repay $7000 of the money.

There is no suggestion of any wrongdoing by or on behalf of Ms Luttrell.

The creditors, Mr Robinson, who is owed $284,323, and the Australian Taxation Office, which is owed $151,182 by way of missed superannuation payments, resolved on April 8 to authorise liquidator Shelley Brooks, of Rodgers Reidy, to enter into an agreement with Ms Luttrell to settle the matter.

“The liquidator will receive $500 a month in 14 instalments and/or until the settlement is fully paid, including the lodgement of a caveat over the property owned by Nicole Luttrell to secure this claim,” the resolution, recorded in meeting minutes filed with corporate regulator ASIC, says.

Ms Brooks told The Mercury she was unable to ascertain how much money could be recouped from Kendall, as the defendant remained incarcerated and the compensation order was in the hands of the Department of Justice’s Monetary Penalties Enforcement Service.

“They have to collect (the compensation)... I can’t just waltz along,” she said.

Ms Brooks said ATO and Rodgers Reidy solicitors were currently in negotiations with MPES to ascertain what could be recouped.

Employees’ missing superannuation benefits take precedence over Mr Robinson’s claim.

As to the $27,000 transfer to Ms Luttrell, Ms Brooks said there had been “some evidence provided” to her office which suggested “some” of the money Ms Luttrell received was then transferred to Kendall.

The provenance of the $27,000 transfer remains unknown.

It is not suggested Kendall was the one who transferred the money to her daughter.

Ms Luttrell was contacted for comment.

In October last year, Kendall was sentenced on appeal, after pleading guilty to three counts of computer-related fraud, to four years’ imprisonment, with a non-parole period of 18 months backdated to August 24, and ordered to repay $347,849.

She had already paid restitution of about $73,000 at the time of her sentence, the court previously heard.

He’s on the age pension, in ill-health, and sinking further into debt with the Australian Taxation Office as interest continues accruing on the employee superannuation his company P.J. Robinson Pty Ltd, which also operated wholesaler Robinson Meats, never paid, courtesy fraudulent bookkeeper Cheryl Ann Kendall, who frittered away $420,000 on gambling.

“I’ve got nothing,” he said.

“I’m the one who got robbed and I’m the one who’s still suffering two years later.

“It’s not fair.

“I had the money there and all of a sudden you’ve got nothing.

“I’ve not received a cent back.”

Mr Robinson, as director of the doomed business, is owed $284,323 – enough to give him the comfortable retirement he deserves – but any funds recouped from Kendall will also have to be shared with the Australian Taxation Office, which is owed $151,182.

He said he wanted the ATO debt to be settled before his.

“It’s okay for the money to go to the tax man, I’d rather my staff get paid before me,” Mr Robinson said.

He remained angry, however, at what he perceived to be indifferent treatment by the Department of Justice’s Monetary Penalties Enforcement Service, who he alleged “did not have the decency to return my calls”.

A departmental spokeswoman refuted the allegation, telling The Mercury staff remained in “regular contact with Philip” and met with him a fortnight ago.

She revealed the incarcerated Kendall continued to make fortnightly deposits to MPES, but that they were “reasonably small amounts”.

The spokeswoman said she was unable to say whether MPES had transmitted any compensation to liquidator Shelley Brooks, of Rodgers Reidy, yet, but it could be the case funds are required to reach a certain threshold amount before remission.

Meanwhile, ‘Robbo’s’ wait for justice goes on.
