TWO brothers accused of murdering Rex Court in Mount Gambier in a wild street brawl are negotiating a plea deal with prosecutors, a court has heard.

Jordan and Dominic Von Stanke appeared in the Adelaide Magistrates Court today where prosecutor Mark Norman, SC, sought an adjournment to “consult with the deceased’s family” before the case could “resolve without a trial”.

“I apologise we haven’t been able to resolve this matter sooner, it’s complex legally and very complex factually,” Mr Norman said.

He said Mr Court’s family had also asked for a restorative justice conference to be held in Adelaide.

The court has previously heard the Von Stanke brothers, of Carpenters Rocks — 35km south of Mount Gambier — allegedly used professional wrestling moves to kill Mr Court in a street brawl following a verbal altercation in Commercial St, Mount Gambier, on May 13 last year.

In December, prosecutors withdrew a murder charge against a third person charged over Mr Court’s death, a youth who cannot be named for legal reasons. The youth remains charged with one count of aggravated causing serious harm.

The brothers will return to court next month.
