Kilburn Football and Cricket Club being sued by Norma Wells over dislocated ankle at Blair Athol Oval

An Adelaide football and cricket club is facing a six-figure bill after a woman tripped at its oval, dislocating her ankle.

Tiser Explains: How a civil trial works

An Adelaide football and cricket club will have to pay up after a woman fell over a raised cement platform – and it could have to pay $100,000.

Norma Wells has launched legal action in the District Court over the fall, accusing both Port Adelaide Enfield Council and the Kilburn Football and Cricket Club of causing her injury through negligence.

However, in documents released by the court, the council has sought to have the sports club pay any and all damages for the fall, arguing the club is entirely at fault.

Ms Wells was 56 at the time of the fall on March 30, 2019.

She attended the oval at the Blair Athol Reserve and walked to a concrete viewing area to the west of the playing field.

After standing stationary for a few moments, she started walking east but fell over a raised portion of concrete which was laid against the platform, but was not flush with it.

Ms Wells said in her statement of claim she suffered serious injuries to both ankles and was unable to stand because of the pain.

Nearby bystanders had to come to her aid and she was taken to the Royal Adelaide Hospital by ambulance.

Ms Wells needed surgery two days after the accident and also had two other operations to help her left ankle heal.

She needed a wheelchair or a walker for eight weeks and was then on crutches for a further three to four weeks.

Ms Wells was employed as a disability services worker at the time and was unable to work for four months after the fall.

She also claims in the court documents to have suffered associated physical and mental health issues.

In a cross claim filed with the court, the council lays all the blame at the foot of the sporting club.

The council claims the sporting club leased the site, including the clubrooms and paved area from them since 2008.

Without admitting any liability, the council asked the court to order that the sporting club pay any damages awarded against the council.

The council, in its separate defence to the allegations, refutes that it was negligent in any way.

In January and February of this year a District Court judicial registrar entered default judgments in favour of the council and Ms Wells against the sporting club.

The sporting club had not filed a defence to the claims. The matter will come back before the court later this year for an evaluation of damages.
