A MAN charged with attempted murder will remain in custody for allegedly trying to pull his girlfriend towards a moving train in Adelaide, despite technically being granted home detention bail.
The decision in Adelaide Magistrates Court on Tuesday to release Lucas Gary Narkle from custody has been put on hold to allow prosecutors to appeal to the Supreme Court.
It’s alleged the incident involving Narkle, 18, and his girlfriend was caught on CCTV at a train station in Adelaide’s north in October.
The court was told that the alleged victim was refusing to co-operate with the police investigation and that issues of mental health were involved.
It also heard that neither the alleged victim nor Narkle crossed the white safety line on the train platform during the incident which occurred as a train was approaching the station.
Magistrate Greg Fisher ruled that home detention bail was suitable but stayed his decision to allow prosecutors to argue in the Supreme Court against Narkle’s release.
A hearing is expected to be scheduled within the next few days with Narkle to return to Adelaide Magistrates Court on January 25.
