A teenager is facing a litany of charges after an off-duty police officer caught him in a stolen car and was allegedly seriously assaulted for his trouble.

A teenager is facing a litany of charges after an off-duty police officer caught him in a stolen car and was allegedly seriously assaulted for his trouble.
Mackay police said the officer was at Andergrove Boat Ramp on Monday, January 8 before 11am when he saw a Nissan Qashqai which was believed to have been stolen and Milton Colin James Daniel.
The off-duty officer approached the 19-year-old Blackwater man and began talking to him.
Police allege Mr Daniel attempted to re-enter the stolen car to leave when an unmarked police vehicle approached the area, but was prevented from doing so by the off-duty officer.
A physical altercation took place and police allege the off-duty officer was assaulted and received non-life threatening facial injuries.
Mr Daniel was arrested and appeared via videolink from the watchhouse in Mackay Magistrates Court on Tuesday, January 9 charged with serious assault of a police officer, obstructing police, unlawful use of a motor vehicle and dangerous driving from the January 8 incident.
Mr Daniel is further charged with two more counts of unlawful use of a motor vehicle, common assault, assault occasioning bodily harm whilst armed or in company, receiving tainted property, break and enter, using a vehicle with plates attached from another vehicle and fraud.
Mr Daniel applied for bail and his ATSILS lawyer Daniel Lane said he was “prepared to submit to any condition the court deems appropriate”.
Mr Lane said his client was motivated to commence his rehabilitation “given the severity of the charges”, but Magistrate Damien Dwyer said he doubted Mr Daniel had “seen the light”.
“The evidence, it seems to me, Mr Lane, is very strong,” Mr Dwyer said.
“And that indicates that he’s not prepared to comply with court orders.
“It smacks of ‘I’ll say anything to get out of prison’.”
The court heard Mr Daniel completed a term of probation in November 2023 yet refused referrals to support agencies, failed to report on two occasions, and travelled interstate without a permit.
“The offending is very serious (and) you’ve just come off probation which you have not responded well to,” Mr Dwyer said.
“In fact, you’ve done nothing.
“I’m not satisfied you’re not going to commit any further offences.”
Mr Daniel’s bail application was rejected and he was remanded in custody with his matters adjourned to January 30.
