Cody James Leigh Skinner caught drink driving while serving suspended jail sentence

A concreter’s decision to drive to McDonald’s after a night of drinking has landed him in court.

Driving to McDonald’s for a boozy late night snack has cost a Toowoomba concreter $700.

Cody James Leigh Skinner fronted Toowoomba Magistrates Court on Friday where he pleaded guilty to one count each of drunk driving and disqualified driving.

Police Prosecutor Tim Hutton told the court police from the Toowoomba Dog Squad intercepted Skinner on Donahue Street about 2.10am on June 23.

“Police observed an open container of alcohol in the centre console,” he said.

“The defendant said he had been drinking in town and wanted to get some McDonald’s on the way home.”

The court heard Skinner was detained and a specimen of his breath returned a blood-alcohol reading of 0.143 – almost three times the legal limit.

Senior Sergeant Hutton said further checks revealed Skinner’s licence had been suspended, and he was subject to a jail term that had been suspended for 12 months.

Skinner represented himself and told the court that there was no excuse for his behaviour.

“It was a silly mistake,” he said.

Magistrate Claire Kelly issued a $700 fine, disqualifying Skinner from holding a driver’s licence for three months.

Rather than activate the suspended sentence, Ms Kelly extended the operational period by three months, to February 2025.

All convictions were recorded.
