A mum and dad accused of murdering their infant child through neglect have both had their legal battles come to a standstill, following the former’s sovereign citizen outburst in the Mackay courthouse.

Mackay parents Adam Joseph Hanbury and Jessica Blinda Hanbury nee Polsoni are facing murder charges after they brought their unresponsive two-year-old daughter Diana to hospital on December 29, 2022.

On Wednesday Mr Hanbury’s barrister and prosecution mutually agreed to delay his listed committal due to the actions of his wife.

Police prosecutor Sheena Gravino said “the co-accused” Ms Hanbury had “taken unknown paths for the committal” and the planned course had to be deferred “to protect Mr Hanbury’s interest”.

When Ms Gravino suggested adjourning Mr Hanbury’s matters a month to allow the coaccused matter to play out, Magistrate Bronwyn Hartigan predicted it was “not going to take a month”.

Ms Polsoni had caused an upset when she appeared for a mention in June flanked by supporters, to both sack her lawyer Adam Harvey and attempt a sovereign citizen inspired edict before Magistrate Damien Dwyer ordered her arrest for refusing to answer to the name Polsoni.

Her bail was cancelled and she was led to Mackay watchhouse by two detectives, followed by uniformed police and Ms Polsoni’s supporters.

So-called ‘sovcits’ are known to attempt to separate themselves from their legal name in an attempt to exempt themselves from laws they disagree with.

A friend of Ms Polsoni, Heidi Ward, attempted to file a “writ of habeas corpus” in relation to the arrest, which successfully overturned her arrest warrant with a certiorari order in the Brisbane supreme court.

In her appeal decision Chief Justice Helen Bowskill agreed the arrest was unlawful despite the growing inconvenience of such “pseudolegal” rants in Queensland courtrooms.

Ms Polsoni has remained in Mackay while Mr Hanbury was bailed to South Australia.

Ms Hartigan adjourned Mr Hanbury’s matter to a month away to see how Ms Polsoni’s matter “plays out”, with a mention date set for September 11.
