An Umina Beach man found by police in his car losing consciousness had to have part of his penis glued back together after he was attacked by another man during a heated confrontation, a court has been told.
Baylee Carter, 23, pleaded guilty in Gosford Local Court on Friday to charges of assault occasioning bodily harm and using a third party to influence a witness to give false evidence.
Carter’s lawyer entered the pleas on his behalf while he appeared via video link from prison.
Carter was at the Hobart Ave home in Umina Beach on April 29, 2023, when he bumped into the victim at a social gathering.
At some point after 6:30pm, a brief verbal argument happened between Carter and the victim. The victim asked, “What the f--- are you going to do?” before Carter allegedly replied, “F--- you.”
Carter then stood nose-to-nose with the victim, with his hands in his pockets, before striking him in the groin, according to police facts.
“The victim could see blood trickling through the ripped patches in his jeans and onto his white shoes,” court documents state.
The victim did not physically retaliate and drove away, trying to act casual as he did not believe others were aware he had been injured.
While driving down Ocean Beach Rd, his vision became dark and blurry, and he called his partner telling her he had been stabbed, the facts continue.
A police officer later found the victim stopped in the middle of the road about 3km from the house in Hobart Ave, losing consciousness.
According to court documents, the victim suffered an 8mm cut to the epidermis of his penis, as well as bruising and swelling to his scrotum. The cut was closed using glue.
He later provided police with a statement from the hospital.
Following Carter’s arrest on May 2, 2023, he allegedly made a number of calls from custody in an attempt to influence the witness.
On May 21, 2023, Carter spoke to an associate and asked if he could help persuade the witness to withdraw his statement.
The following day, Carter spoke to his partner at the time, saying the victim would be asked to identify him as the offender.
On May 24, the victim withdrew his statement identifying Carter, instead telling police Carter had not injured him that night and insisting he had not been threatened or influenced to change his account.
Carter will be sentenced in the Gosford District Court on April 18.
