SA court orders Malcolm Winston Day to stand trial on child sex charges, despite prosecutors asking for further time

A court has ordered an Adelaide man to stand trial on child sex charges, despite prosecutors wanting more time to ensure the second alleged victim will proceed with the case.

An Adelaide man has been ordered to stand trial, accused of committing multiple child sex offences in the mid-1980s.

Malcolm Winston Day, 77, faced the Adelaide Magistrates Court on Thursday.

He pleaded not guilty to two counts of unlawful sexual intercourse and one count each of indecent assault and persistent sexual exploitation of a child.

Prosecutors allege the offences were committed against two children, and at an inner southern suburb, between 1985 and 1987.

On Thursday, they asked the court to adjourn Day’s case while they spoke with the second alleged victim to determine “whether the charges are proceeding”.

Magistrate Simon Smart refused, saying that was an issue that could be determined once the matter had reached the District Court.

He remanded Day on continuing bail to face that court in August.

Asked to comment outside court, Day told reporters to “get out of my way”.
