A drunk driver who hit and killed a young man walking on a dark stretch of road will serve at least 2½ years in prison and the judge concluded it was not his first time drink driving.
A service station attendant, who worked across the road from the southern suburbs hotel frequented by Joshua Burroughs Norman, said she had called police 12 times about the 24-year-old being drunk behind the wheel.
Norman had a blood alcohol reading of at least .191 when he hit and killed Adam Joseph just before 4am on December 29, 2018 on Black Rd, O’Halloran Hill.
Despite the efforts of paramedics, Mr Joseph died at the scene. Norman was charged with aggravated causing death by dangerous driving.
A District Court, packed with supporters of Norman and family and friends of Mr Joseph, yesterday heard police had investigated reports of Norman’s drink driving on three occasions.
Judge Jane Schammer said only one instance of drink driving was proved beyond all reasonable doubt.
After the sentencing Mr Joseph’s father David said it was another case of good versus bad decisions.
“Adam made a good decision to walk and catch an Uber after a nights drinking,” he said. “Joshua Norman made a bad decision to drink and drive and he killed my son.
“On November 19, Mr Norman stated to the media ‘I hope some day they will be able to get through this and be what they were like before’. Nothing will ever be like it was before.”
Norman was sentenced to three years, two months and one week in prison with a non-parole period of two years, six months and three weeks. He will be eligible for parole in mid-2022.
