A Highton man ran at his neighbour with a scraper and hammer in a fight over fencing, sparking a tussle that left the victim with a gash in his neck

Rouhallah Akbar Abadi, 39, pleaded guilty in the Geelong Magistrates Court on Tuesday to recklessly causing injury.

The court heard a dispute over paying for fencing broke out between the victim and Abadi.

The victim told the court he owned two adjacent properties to Abadi in Dryden Way, Highton and had planned to install fencing.

He told the court he had a conversation with Abadi about the fences and asked him to contribute to the cost.

About 4.30pm, on May 10 last year, Abadi became agitated with the victim and went to his van to grab tools, including a hammer and a scraper.

The court heard Abadi ran towards the victim with the two items in his hands, and managed to grab his wrists, before the pair eventually tumbled over each other.

During the tussle, a number of kicks and punches were exchanged.

The court heard the victim suffered a cut to his neck during the commotion as something made contact with his flesh.

The victim told the court he did not see Abadi use the scraper to cut him.

Moments after the confrontation, the fight was broken up by labourers who were at the property installing fencing.

The victim told the court the incident happened quickly, and he was in a “state of shock” afterwards.

“I just sat there holding my neck, a lot of blood was coming out,” he said.

The court heard the victim needed stitches for the wound.

Magistrate John Bentley placed Abadi on a 12-month good behaviour bond with no conviction.
