A magistrate has warned a Geelong brickie he could have killed someone, after he held a woman in a doorway and strangled her until she thought she was going to die.

A Geelong brickie held a woman in a doorway and strangled her until she thought she was going to die, a court has heard.

Jackson Bogaers, 23, appeared in Geelong Magistrates Court on Thursday, facing charges of reckless conduct endangering life, unlawful assault and property damage stemming from the attack.

Bogaers had intended to fight the charges at a contest mention, however he eventually pleaded guilty after being given a sentence indication by magistrate Urfa Masood.

Ms Masood said any “allegation of strangulation is very serious” and warned Bogaers he could have killed the woman.

“All it takes is another 10 or 20 seconds and a person can die,” Ms Masood said.

Police prosecutor Senior Constable Andrew Clapham told the court that on January 15, 2024, Bogaers and the woman argued over money when Bogaers decided to leave and pack his things.

Constable Clapham said during the argument, Bogaers grabbed the victim “by the neck” and held her against a doorway.

The woman “believed the accused was going to kill her” Constable Clapham said.

The court heard Bogaers grabbed the victim’s arm and pushed her into the room, before pinning her on a bed with his legs on either side of her and punching her “six or seven times”.

The victim’s grandmother arrived shortly after the assault and Bogaers went outside and waited for police to arrive, where he was arrested.

When interviewed by police, the court heard Bogaers denied assaulting the woman and told police he “got up in a s**t mood and took (his) anger out on everyone else”.

Bogaers told police in his interview he moved the woman out of the doorway “as gently as (he) could”, the court heard, and said he was just trying to pack up his things.

Constable Clapham told the court the victim attended hospital after the assault, where she reported a sore neck and head.

Defence lawyer Shane Balkin said Bogaers, who works as a bricklayer, knew the charges were serious.

Bogaers had completed an anger-management course in March, following a “nightclub incident” five years ago, Mr Balkin told the court.

“He has a limited history, but obviously does have anger issues,” Mr Balkin said.

Ms Masood said it didn’t “immediately appear” to be a weak prosecution case, and warned that if the matter proceeded to a contest mention that Bogaers would lose any sentencing discount from a guilty plea and if he was found guilty, jail would have been “well within range”.

After his guilty plea, Bogaers was assessed for a community corrections order (CCO), and the report was “encouraging” Mr Balkin told the court.

Ms Masood said Bogaers had shown a “good attitude, remorse and insight” in his CCO assessment interview and accepted responsibility for his actions.

Bogaers was convicted and sentenced to a 14-month CCO, which will include 80 hours of unpaid community work.
