A Corio man who used a metal pole to force his way into a property where his ex-partner and her new boyfriend were present has been sentenced.

A Corio man who used a metal pole to confront his ex-partner and her new boyfriend has avoided further jail time.

Bradley Luke, 29, was sentenced to a three-year community corrections order after pleading guilty to aggravated burglary and intentionally damaging property, the Geelong County Court heard on Wednesday.

Judge Geoffery Chettle told the court “people are commonly sentenced to imprisonment” for this type of offending, before showing leniency.

“You have good prospects in my view of rehabilitation,” he said.

“If you are imprisoned you will lose your employment and will no longer be able to pay the mortgage on your home for you and your daughter.”

Luke was taken into custody on May 15, 2021 after using a metal pole to smash the kitchen window of a Corio property where his ex and her new partner were present.

After climbing through the window, he continued to force his way through the house before confronting his ex’s new boyfriend.

After getting into an altercation with the man, Luke handed himself over to Corio Police and remained in custody until he was bailed on July 2.

The court heard Luke is the full-time carer of his daughter and is expecting another child with his current partner in June.

Luke was released on a three-year community corrections order with conditions including unpaid community work, assessment and treatment for mental health issues and programs to reduce reoffending.

“You have a good job, a daughter, a supportive mother, you need to stop getting involved in the legal system,” Judge Chettle said.

“I don’t want to see you again.”
