Carl Andrew Brodie had multiple domestic violence charges dismissed in court

An Afghanistan war veteran has had multiple domestic violence charges, including choking, withdrawn in court after a charge determination was not made.

A father who police previously alleged choked his partner until she couldn’t breathe walked free from court after his charges were withdrawn.

Carl Andrew Brodie, 38, had multiple domestic charges dropped in the Adelaide Magistrates Court last week, including assault and choking, suffocating or strangling a person.

The court heard a charge determination had not been made so Mr Brodie’s charges were dismissed.

During Mr Brodie’s successful home detention bid in March, the court heard the now withdrawn charges related to Mr Brodie’s domestic partner who he shared a child with.

The court heard Mr Brodie and his partner got into an argument on February 1, 2023 and Mr Brodie allegedly slapped her to her face.

“She was then pushed to the ground,” the prosecutor said.

“The defendant then knelt down and placed his right knee on her throat, causing her to be unable to breathe or speak.

“She states she nearly lost consciousness at that point.”

The court heard the woman sustained cuts and bruising and a sore throat and neck.

David Moen, for Mr Brodie, told the court during the bail application his client was a war veteran.

“He was in Afghanistan for a long period of time,” he said.

The court heard the woman now lives interstate.

Last week, Mr Brodie, of Glanville, was released from his bail agreement.
