Dylan Pedler faces three counts of unlawful sex after allegedly picking up a 16 year-old girl from the side of the road

A Spencer Gulf man stands trial accused of having unlawful sex with an underage girl, allegedly feeding her booze and lies in order to gain her trust.

A 30-year-old man has faced court accused of having sex with an underage girl, after allegedly grooming her with friendship, lies and booze.

Whyalla Norrie man Dylan Wayne Pedler faced the Port Augusta District Court on November 28, pleading not guilty to three charges of unlawful sex.

The court heard Mr Pedler and Joel Lloyd Pace, 32, allegedly offered a car ride to two underage girls, aged 14 and 16 respectively, before buying them alcohol and taking them to a residence where the alleged sexual assault occurred.

Joel Lloyd Pace, who is being tried separately, is additionally accused of providing drugs to the victims, the court heard.

During her opening remarks, prosecutor Mollie McKendrick told the jury that Mr Pedler used the fake name “Daniel” and told the girls he had a girlfriend in order to gain their trust.

“He picked her (the victim) up with the sole intention of grooming her by gaining her trust with alcohol,” Ms McKendrick said.

“After driving around town they took the girls to a bottle shop where they purchased 24 cans of Smirnoff Black, a beverage with two standard alcoholic drinks per can.”

“At one point in the evening Mr Pedler even offered to go to Adelaide to purchase fake IDs for the girls.”

Ms McKendrick said the decision from the girls to get into the accused’s car was an innocent one born from boredom.

“They drove around Whyalla, visited Hummock Hill, before stopping at the beach,” Ms McKendrick said.

“The men encouraged the two girls to kiss, saying that if they didn’t they would leave them at the beach.

“The girls initially become suspicious when Mr Pace laughed at Mr Pedler’s fake name when driving.”

The court heard that after arriving at the accused’s residence, the victims were offered drugs before Mr Pace took the 14-year-old into a bedroom and Mr Pedler followed the 16-year-old into a shed behind the house.

“It was in the shed where he grabbed her by the hips and started touching her bottom,” Ms McKendrick said.

“The accused repeatedly said ‘let me f**k you’ even after repeatedly being told by the alleged victim that she was 16.

“He then turned her around and bent her over a washing machine before repeatedly entering her.”

Ms McKendrick described the alleged victim as being completely “dissociated” after the event.

During their initial inspection of the property, police allegedly found a board that Mr Pace had allegedly placed a white substance onto.

Prosecutor Ms McKendrick told the court that it was swabbed by police and forensics and was found to contain traces of meth.

“A swab conducted on the alleged victim’s underpants found DNA that was 100 billion times more likely to belong to the accused than anyone else,” Ms McKendrick said.

Defence lawyer Michelle Barnes spoke briefly, stating that the defence will focus on whether or not Mr Pedler believed that the alleged victim was 17 when the incident occurred.

The trial will continue in the district court this week.
