Only one thug has escaped jail after a southern suburbs restaurant owner was set upon by a drugged-up group and hacked at with a knife.

A trio have been sentenced after they viciously attacked a Christies Beach restaurant owner in a gang attack, with only one escaping jail.

Aydin Lenart, 21, walk free from court over the bizarre incident, while his accomplices, Tyrone Bradley Thompson, 23 and Connar Aiden Pails, 21, are now behind bars.

The trio, along with Baylee Luke Pickett and a 17-year-old, attacked the owner of the Southern Palace Chinese restaurant on Gulfview Rd in January 2022.

During sentencing on Monday, the District Court heard the victim heard noises while he was working and observed fresh graffiti at the rear of his restaurant when he went outside to investigate.

He saw the group and waved a knife at them, telling them not to come any closer.

“Your group chased after the victim and physically attacked him,” Judge Anthony Allen said.

The victim received a heavy blow to his right eye and had his gold chain, valued at around $10,000, stolen during the attack.

The court heard Pails, who had armed himself with the victim’s knife, also stabbed the victim to his left hand in a “hacking motion”, causing significant blood loss.

The trio pleaded guilty to causing harm with intent, while Thompson also pleaded guilty to robbery.

Pickett was sentenced to two years of home detention in 2022 after pleading guilty to causing harm with intent.

The court heard the offending had a significant impact on the victim who suffered both physical and mental trauma, impacting his ability to return to work.

The court heard Thompson, a father, had been on a five day drug bender at the time of the offending and had poor recollection of the events.

The court heard Pails and Thompson also had drug issues but were seeking assistance.
Judge Allen said the group had the overwhelming weight of numbers in their favour during the “callous” attack.

“Your actions were cowardly and completely unnecessary,” he said.

Thompson was sentenced to three years and 10 months jail, with a non-parole period of one year and eight months jail.

Pails was sentenced to three years and four months jail, with a non-parole period of one year and seven months.

Lenart was sentenced to three years and one month jail, with a non-parole period of one year and six months.

However, due to his lesser role in the offending, traumatic upbringing and rehabilitation efforts, the sentence was suspended on a $500, three year good behaviour bond.
