Jacob Leigh Forsyth faces court for indecent behaviour charge

“Here we are again”: A southern suburbs man who has been caught masturbating in public places multiple times has faced court on another charge of indecent behaviour.

An Aldinga Beach man with a history of masturbating in public has faced court on another indecent behaviour charge.

Jacob Leigh Forsyth, 27, was found guilty at a trial in the Christies Beach Magistrates Court of committing an indecent act at the Seacliff Esplanade in November 2018.

Magistrate Lynette Duncan said in court on Monday that Forsyth had previously been placed on a good behaviour bond and received a suspended sentence for similar offending.

“This is essentially now the fourth time that he’s committed an offence like this,” she said.

“It was made clear to him by the magistrate on the last occasion that if it happened again there would be serious consequences and here we are again.”

Court documents showed Forsyth was previously charged and convicted of two counts of indecent behaviour in 2016 and charged without conviction for committing grossly indecent acts in 2015.

In the 2015 incident, Forsyth entered an adult shop in Christies Beach and was caught on CCTV masturbating and then ejaculating onto the floor of the store.

In the 2016 incident, he was caught masturbating in a car in view of some women.

Court documents said the incident was “highly upsetting for the victims” and required a “degree of premeditation” due to the placement of the car.

A police prosecutor told the court on Monday immediate imprisonment was the only appropriate option in regards to the 2018 offence.

A defence lawyer said Forsyth should be referred to a specialist rehabilitation program for people who commit sexual offences.

“I would ask your honour to fashion a sentence that is aimed fairly and squarely at protecting the community not just now but to come by giving Mr Forsyth the chance to participate in that course and do that in the community,” she said.

Forsyth will appear in court later this week for sentencing.
