A vape store owner has sold his share of his business after his disgusting habit came to light as he was too ashamed to keep working.
David Philip Prior, 40, narrowly avoided jail in the Adelaide Magistrates Court on Monday, after receiving a further conviction for exposing himself in public.
The court heard a woman had stopped at traffic lights on July 25 last year at Park Holme when she encountered Prior in his car.
“She had her four-year-old daughter as a passenger in her car,” Magistrate Karim Soetratma said during sentencing.
“You had smoke billowing out of your car which drew the victim’s attention … she saw you pull out your penis.”
The “distressed” victim distracted her daughter and believed she had not seen anything.
Mr Soetratma said Prior’s offending seemed targeted as there had been about four or five car spaces in front of him when he stopped next to the victim.
The court heard Prior who told police he was an “active vaper” was also caught driving disqualified the next day, at Edwardstown.
Prior, of Happy Valley, had previously pleaded guilty to indecent behaviour and driving disqualified.
The court previously heard Prior had nine convictions for indecent behaviour.
Mr Soetratma said Prior’s criminal history had caused him “some alarm”.
“I was searching for a reason not to put you in jail,” he said.
The court heard Prior is now getting help for his sexual misbehaviours and drug and alcohol problems.
Mr Soetratma said Prior should feel great shame and embarrassment for his actions.
“Hopefully that will deter you from ever offending in this way again,” he said.
The court heard Prior, who had owned two vape stores, was too ashamed to work after the media publicity and sold his share to his business partner.
Mr Soetratma sentenced Prior to 21 days jail.
It was suspended on a three year good behaviour bond for $750, with supervision for two years.
