Christopher James Neos pleads not guilty to indecent behaviour after he was allegedly caught in a Macca’s drive-through

A middle-aged man has denied he was performing a sexual act on his passenger when he allegedly failed to pull up to pay for his McDonald’s drive-through order.

A middle-aged man has denied performing a sexual act on his partner while waiting in a southern suburbs fast-food drive-through, a court has heard.

Christopher James Neos, 38, pleaded not guilty to one count of indecent behaviour in the Christies Beach Magistrates Court last week.

The man was charged after a witness claimed he allegedly found Neos and his partner engaging in a sexual act at the drive-through at McDonalds in Seaford earlier this year.

A police prosecutor told the court when a Toyota Yaris failed to drive up to the pay window after placing an order, a staff member went to look for the car, allegedly discovering the pair mid-act.

“The hazard lights were operating, the windscreen wiper were operating, the witness called out and approached the driver’s window which was down,” the police prosecutor said.

Neos, who works as a landscaper, denied the allegations put forward by the prosecution and said he had not engaged in the sexual act described by the witness.

Magistrate Rodney Oates told Neos he should obtain a lawyer before his trial date.

Neos will face court again next month.
