Seasonal Garden Cafe owner Silvia Hart yet to receive creditor’s petition in bankruptcy case against her

A bid to bankrupt the owner of a Hahndorf cafe has been delayed because she has not been served with a bankruptcy petition.

A bid to bankrupt the owner of a Hahndorf cafe and wedding venue has been delayed because she has not been served with a bankruptcy petition.

A bankruptcy hearing in the Federal Circuit Court heard today that lawyers for Pooraka-based fruit and vegetable wholesaler AMJ Produce were yet to issue a creditors’ petition against The Seasonal Garden Cafe’s Silvia Hart.

A creditors’ petition and additional affidavits must be personally handed to the respondent at least five days before a hearing.

AMJ Produce’s lawyer told The Advertiser after Tuesday’s bankruptcy hearing that his firm had been unable to personally serve Ms Hart with the petition.

If she is made bankrupt, Ms Hart would be prevented from being a director or being involved in the management of a company.

AMJ Produce secured a separate Federal Court order on July 24 to wind up Ms Hart’s company Maerhuev Pty Ltd after it failed to settle a statutory demand for payment of a $55,000 bill.

Ms Hart has previously said that Maerhuev was separate to the Seasonal Garden Cafe’s Hahndorf branch that any winding up would have no threat to weddings booked at the venue.

Federal Circuit Court Nicholas Parkyn adjourned the bankruptcy matter to September 17.
