Tristian Wilson-Simmons jailed in Adelaide District Court for unlawful sexual intercourse with a child

A convicted child sex offender father who lied about his age before having sex with a child had avoided jail for similar offences only years prior.

A child sex offender who had already been given a chance to rehabilitate himself ended up reoffending against a different child.

Tristian John Wilson-Simmons, 24, was jailed in the Adelaide District Court last week for his predatory act, despite being in a relationship at the time.

The court heard Wilson-Simmons met the victim, who was aged 13 at the time, through a mutual friend and started messaging her on social media.

Wilson-Simmons and the victim were hanging out with other friends in April, last year.

“You decided to go into the lounge room so you did not wake the others, you told the victim that you were 18,” Judge Liesl Chapman said during sentencing.

Wilson-Simmons then got the victim to touch him sexually.

The court heard Wilson-Simmons and the victim hung out again in a group on June 15, last year.

“You asked the victim to have sex with you,” Judge Chapman said.

“The victim went with you into the lounge room and the two of you had sexual intercourse.”

Wilson-Simmons’ partner at the time reported him to police two days later.

Wilson-Simmons, of Kilburn, had previously pleaded guilty to unlawful sexual intercourse with a child and indecent assault.

The court heard Wilson-Simmons was convicted of unlawful sexual intercourse with a child in 2017 and handed a suspended sentence.

Wilson-Simmons had met the 15-year-old victim of that offence through a group chat on Facebook.

“You feel that you have been unemployed in recent years mainly because you are a convicted sex offender,” Judge Chapman said.

Wilson-Simmons, who has below average intelligence, had a child with his former partner last year.

“Your level of intellectual functioning makes you vulnerable to being led astray by people who should otherwise have been helping you to stay out of trouble,” Judge Chapman said.

“People in the community need to know that committing such crimes against children will be met with strong punishment.”

Judge Chapman sentenced Wilson-Simmons to four years and three months jail, with a non-parole period of one year and 11 months.

The sentence was backdated to June 19, last year.
