A convicted man who allegedly indecently assaulted a young boy on multiple occasions will have more freedom on bail.

Scott Leland McIntosh, 48, applied to have his home detention conditions removed in the Adelaide Magistrates Court last week, contesting the alleged abuse.

The court heard the alleged victim was the son of a person Mr McIntosh knew.

A prosecutor said they were opposed to the application, saying the alleged victim and his family had “genuine concern” Mr McIntosh would try to contact or visit them if released from home detention.

“There were times during the alleged offending where the accused would arrive at their property unannounced,” the prosecutor said.

The court heard McIntosh was convicted of two counts of indecent assault in 2003 against a young male.

Mr McIntosh, of Pooraka, is charged with maintaining an unlawful sexual relationship with a child and indecent assault.

Court documents allege Mr McIntosh indecently assaulted the child by touching his penis on multiple occasions last year.

It is further alleged that the child was under the age of 14 years at the time of the offences.

If found guilty, the maximum penalty for maintaining an unlawful sexual relationship with a child is imprisonment for life.

Joseph Henderson, for Mr McIntosh, told the court his client was a self-employed electrician and wanted to have more freedom with his employment.

“He has a significant amount of work available to him in Walker Flat as a consequence of the recent flooding in the region there,” he said.

Mr Henderson said the charges were going to be contested and a trial would be at least a year away.

Mr Henderson said the alleged victim could be adequately protected with the non-contact clauses and there had been no breaches so far.

“If my client was to contact or attempt to contact (the alleged victim), he knows precisely where he would go,” he said.

Magistrate Brian Nitschke granted the application and removed Mr McIntosh’s home detention conditions, ordering him to report to a police station every week.

Mr McIntosh was also given conditions to not engage in child related work and not to approach within 50m of the alleged victim’s high school.

The charges were adjourned until April.
