A Magill resident traumatised by a huge rainwater tank installed beside his house by a neighbour has taken the matter to the state’s planning court.
Branko Soda has appealed against Campbelltown Council’s decision to retrospectively approve the installation of the tank.
Mr Soda wants the tank to be moved further away from his house, arguing it sits 600mm from a boundary next to his front verandah.
He discovered the tank had been installed when he returned from a three-week interstate holiday last September, later seeking medical help for stress and anxiety.
Campbelltown Council planning officers conducted an inspection last November following complaints by Mr Soda.
The officers told his neighbour, Baden Greer, he required planning approval for the 2.8m high 46,000 litre green plastic tank because of its size.
Mr Greer and his wife subsequently lodged an application, which was approved by the council’s planning assessment panel in March.
Officers recommended its approval saying the 600mm distance from the boundary was within national construction code guidelines.
Mr Soda has appealed to the Environment, Resources and Development Court, seeking a court order overturning the panel’s decision.
A preliminary conference was held behind closed doors on Monday between Mr Soda, the council and Mr Greer.
None of the parties can publicly comment because the hearing was private.
