A mother of three’s appeal against a seven-week jail sentence for stealing $110 worth of Lego has been dismissed in the Supreme Court.

The 44-year-old woman unsuccessfully argued last month the sentence was manifestly excessive.

She was found guilty in the Adelaide Magistrates Court for dishonestly taking two Lego sets from a Tea Tree Plaza department store on September 22 last year.

The court heard the mum was seen to put both sets of Lego in her shopping bag.

After leaving the store without paying, she was stopped by a loss prevention officer.

In an attempt to deceive the officer, she produced an old Kmart receipt and claimed she had bought the Lego from another store.

However, she later confessed to police, arguing she could not afford to buy a present for her daughter.

The court heard she became addicted to methylamphetamine and had been in “constant trouble with the law” for years.

Auxiliary Justice Michael David said the woman had a lengthy rap sheet dating back to 2000, and was imprisoned in 2017 for two weeks over two counts of theft.

Justice David said her offending was “calculated and clearly planned”.

“It was not a random, spontaneous decision,” Justice David said.

“Her offending for dishonesty is extensive, and she has been given the benefit of two suspended sentence bonds, one good behaviour bond, as well as a number of other non‑custodial sentences.”
