He trafficked meth while on bail for trafficking meth, cut off his ankle monitor while on home detention, and berated police – now this young man has walked free from court in his prison duds.

Walking free from court while wearing his prison duds, a young Modbury man’s penchant for trafficking meth – and subsequent prison term – was a “wake up call”.

Tyson Timothy Delchau, 22, was offered leniency in the Adelaide District Court by Judge Liesl Kudelka after pleading guilty to trafficking meth three times, once while on bail, and trafficking cannabis.

When he was arrested for a second time, Delchau was again released on home detention bail where he proceeded to cut off his ankle monitor and on another occasion delivered a brutal spray to police during an interview.

He was first arrested in July last year when police found his asleep in his car, which incidentally had two bags of meth in it containing 6.65 grams of the drug.

The car search led to the search of his house where they found another 33 grams of meth and almost 300 grams of cannabis which Delchau eventually admitted to police he was going to sell.

Despite coming head-on with the law, Delchau persisted and was busted just five months later while on bail, again in the process of selling meth.

This time he was found with $7575 cash and 6.2 grams of the drug.

Judge Kudelka heard Delchau had returned to the drug trade after his partner miscarried and he turned to self medicating with Xanax – thrusting him back into the grips of addiction.

His addiction led to drug debt, and his drug debt saw him turn to methamphetamine to again get by financially.

Judge Kudelka released Delchau from prison, recognising the near eight months he had spent in custody since being arrested after cutting off his ankle monitor.

“You do have some insight into how bad drugs are for you,” she said.

“If you keep doing drugs you will be spending more time locked up in a prison cell.

“That is no future for a 22 year old.

“This really is a chance for you now to decide which way you are going to go with your life.”

Judge Kudelka sentenced Delchau to a four year prison term with a non-parole period of two years.

She wholly suspended the sentence on him entering into a three-year good behaviour bond and committing to 100 hours of community service.
