Daryl John Gilson allegedly found masturbating at two women’s homes after asking charge his phone and porn popped up

Just released from jail, a meth addict allegedly took advantage of the kindness of strangers by repaying them in an X-rated way, a court has heard.

Daryl John Gilson, 31, is facing two charges of gross indecency and trespassing at Woodcroft in February and applied for home detention bail in the Elizabeth Magistrates Court on Wednesday.

It is alleged he asked to charge his mobile at an elderly woman’s home before propositioning her for sex, being caught masturbating in her kitchen after porn popped up on his phone and then repeating similar behaviour at another home.

Mr Gilson, of no fixed address, was also facing charges of taking property without consent, from the same day, and other allegations of assault, aggravated assault, trespassing and stalking arising from other incidents.

No pleas had been entered to any of the charges.

The police prosecutor told the court Mr Gilson asked a 71-year-old woman, who he had met once before, if he could come inside her home and charge his phone before asking her “do you want to f***”.

“(The woman) walked away from and left him in the kitchen and when she returned he had his pants down around his ankles, and his underwear, and he was masturbating,” the prosecutor said.

“When he left she noticed there was fluid on the kitchen floor which appeared to be ejaculate.”

The prosecutor alleged Mr Gilson then went to another random house and tried to enter it before the owner stopped him and told him if he needed to charge his phone he could do it outside.

“About an hour later she saw him sitting on a chair and masturbating,” the prosecutor said.

Magistrate Benjamin Sale heard Mr Gilson allegedly went to a third home and stole jewellery.

Vanessa Cream, for Mr Gilson, told the court her client was using methamphetamine at the time of the allegations.

She submitted, while not an excuse for the alleged behaviour, Mr Gilson’s lack of secure housing led him to being charged with the gross indecency offences.

“By virtue of being homeless, he doesn’t really have a fixed place to otherwise commit those acts,” Ms Cream said.

“He was homeless, needed somewhere to charge his phone.

“In the course of this phone regaining charge and a previously open web page returning he has found himself in a situation where he has committed an act of gross indecency.”

Mr Sale refused home detention bail “on the basis of the seriousness of the allegations”.

He remanded Mr Gilson to return to court in June.
