A brave resident who confronted the man allegedly in the middle of robbing her house was told he had a gun and he’d shoot her. Now he wants bail to attend his father’s funeral.

A man has lost his bail bid to attend his father’s funeral after he allegedly assaulted a homeowner who he was in the middle of robbing, a court has heard.

John Thomas Shaw, 33, applied for home detention bail in the Adelaide Magistrates Court on Tuesday, accused of threatening to shoot the woman upon confrontation.

A police prosecutor said they were strongly opposed to Mr Shaw’s release on bail, as he was a “very high risk” of reoffending.

The court heard a woman returned to her Salisbury North home on June 27 and saw a man, alleged to be Mr Shaw in her front yard.

Mr Shaw was holding handbags which he had allegedly stolen from her house.

“She (the homeowner) followed him down the driveway yelling at him to stop,” the police prosecutor said.

The court heard Mr Shaw got into his car and the victim followed him.

“He’s then said ‘I’ve got a gun, I’ll shoot you, stay away’ and pushed her once, causing her to fall onto the road,” the police prosecutor said.

Mr Shaw then drove away, with the alleged victim writing down the registration number.

The court heard the woman’s front window had been forced open and numerous items, including jewellery and watches had been stolen.

The police prosecutor told the court further charges were likely to be laid after police arrested Mr Shaw and found a number of stolen items identified from three other break-ins.

The police prosecutor told the court the alleged victim had to undertake counselling after the incident and was very fearful.

Mr Shaw, of Salisbury North, is charged with multiple offences, including serious criminal trespass and commit theft using force.

Taylor Johanson, for Mr Shaw, told the court his father had passed away last month.

“Mr Shaw … has been understandably struggling with the grief of losing his father whilst he’s in custody,” she said.

“They had an extremely close relationship.”

Ms Johanson told the court Mr Shaw lost his wife and their fourth child who she was pregnant with in 2017.

The court heard he then struggled to get back into work and his life spiralled.

Ms Johanson told the court Mr Shaw’s family had been delaying his father’s funeral in hopes he could be there.

“He needs to be home with his family,” she said.

Ms Johanson said the charges, which Mr Shaw is yet to enter any pleas to, would be contested.

Magistrate Roderick Jensen offered his condolences to Mr Shaw for his loss but denied him bail.

The charges were adjourned until October.
