James Curyer pleads not guilty to multiple sexual assault charges in Adelaide Magistrates Court

Police allege his DNA was found at the scene but a 30-year-old man charged with sexually assaulting a teenager has denied any involvement, a court has heard.

A Paralowie man will face trial over allegedly raping a 14-year-old girl he met for the first time that night, a court has heard.

Police allege his DNA was found at the scene but James Marshall Curyer, 30, has denied any involvement in the alleged crime.

Curyer, of Paralowie, pleaded not guilty in the Adelaide Magistrates Court on Monday to five charges of engaging in sexual intercourse without consent and five charges of unlawful sexual intercourse with a person under 17.

Curyer’s lawyer applied to have his home detention conditions removed.

A police prosecutor opposed the application, due to the seriousness of the allegations and the age of the alleged victim.

The court heard prosecutors will allege Curyer raped a 14-year-old girl on the night of April 9, last year in Paralowie.

“He’s come across her walking around the area,” the police prosecutor said.

“He’s then taken her to a reserve where he’s raped her repeatedly.”

The court heard the alleged victim flagged down a passing car and asked the driver if what happened to her was rape, to which the driver said it was.
Curyer and the alleged victim were not known to each other.

The police prosecutor told the court there was DNA evidence linking Curyer to the alleged rape.

The court heard Curyer’s DNA was found in swabs taken from the alleged victim.

Curyer’s lawyer told the court the alleged victim had made contradictory accounts in interviews to police.

“The alleged victim was examined medically, there was no evidence of any penetration that supports the allegation made,” the lawyer said.

“Whilst my client’s DNA has been detected at the scene, he is a mixed contributor to a mixed profile.”

Magistrate Simon Smart denied the application to remove Curyer’s home detention conditions, citing the gravity of the allegations.

Curyer has been committed to trial in the District Court in April.
