A mother whose heroin contributed to the overdose death of a man had a win in court after she was released from jail on a lighter sentence. 

Jade Danielle Symons, 43,  had her jail term suspended after her foolish  decision to help a friend score drugs ended in tragedy. 

The Court of Appeal comprising President Mark Livesey and Justice Sophie David determined last month Symons' sentence was "manifestly excessive".

Symons was sentenced in January to 14 months jail, with a non-parole period of six months .

During sentencing, the District Court heard police attended Symons’ house in February 2019 after she found her friend, Christopher Beagley dead from a suspected drug overdose.

The court heard Symons received a text from Mr Beagley the day before saying he had won $2500 at the pokies and asked to ‘score’ some drugs.

The court heard Symons met Mr Beagley on an online dating app four weeks earlier and were intimately involved.

Symons texted her dealer and asked for $100 of heroin and Mr Beagley arrived and injected the drugs.

Mr Beagley fell asleep, and when he wouldn’t wake for dinner Symons injected him with two vials of Narcan, which she had previously given to other people and caused them to ‘wake up with a big headache’.

“He did not wake up and was still mumbling in his sleep,” Judge Karen Thomas said.

“You checked his pulse and felt it was strong.”

When Symons woke the next day she found Mr Beagley cold and unresponsive.

When paramedics arrived they tried to revive him but pronounced him dead a short time later.

The toxicology report revealed there were traces of methamphetamine, amphetamine, morphine and codeine in Mr Beagley’s blood and urine at the time of his death.

The stated cause of death in the autopsy report was ‘heroin with amphetamine toxicity’.

The Brompton mother pleaded guilty to supplying drugs to another person.

Judge Thomas said she was satisfied that the heroin supplied by Symons was a contributing factor but not the sole cause of Mr Beagley’s death.

In their decision, President Livesey and Justice David re-sentenced Symons to four months and four days jail.

Due to her limited criminal history and month spent in custody, the sentence was suspended on a $100, 12-month good behaviour bond.
