A predator is eligible for parole after he performed a vile sex act in front of two of his young son’s friends, a court heard.

The 41-year-old man, who cannot be named for legal reasons, committed his “disgusting and depraved” actions after alcohol abuse led him to lose his moral compass.

During sentencing, the District Court heard the first victim, who was aged 10, was a friend of the man’s son and was over his house in 2014.

While the victim and the man’s son were playing video games, the man called out to him.

“He turned around and noticed that you had removed your penis from your boxer shorts and were masturbating in front of him,” Judge Anthony Allen said.

The victim immediately asked to be dropped home and despite his parents reporting the incident to police nothing further came of it at that time.

The court heard another friend of the man’s son attended his house in 2016.

The victim, who was aged about 12 or 13, got up to go to the bathroom after playing video games.

‘As he did so, he noticed you standing in the hallway looking directly at him,” Judge Allen said.

“You were wearing only a pair of shorts, you were masturbating with both hands.”

Two years later, when the same victim was about 15 years of age, the man contacted him by Facebook Messenger.

“You placed a number of audio video calls, together with written messages, which were clearly communicated with the intention of making the victim amenable to sexual activity,” Judge Allen said.

“Your messages enraged the victim, who told you that he would have you sent to jail.”

The Ingle Farm man pleaded guilty to two counts of gross indecency and one count of communicating with the intention of making a child amenable to sexual activity.

The court heard the man was drinking alcohol every day to the point of passing out at the time of the offending.

“Of course this does not excuse your behaviour, but tends to explain how you came to act in such a disgraceful and depraved way,” Judge Allen said.

“You appreciate that alcohol causes you to lose your moral compass, leading you to do stupid things and bring you into conflict with the law.”

The court heard the man had been given a chance to mend his relationship with his sons after they gave him an ultimatum to never consume alcohol again.

The court heard the man, who was now a grandfather, was very embarrassed and remorseful for his actions.

“Quite frankly, you have too much to lose if you revert back to your old ways,” Judge Allen said.

Judge Allen sentenced the man to two years and 10 months jail, with a non-parole period of one year and 10 months.

The sentence was backdated to November 3, 2020, meaning the man is eligible for parole.
