A northern suburbs pedophile who was snapped at court covered in sweat following his arrest has been jailed after he was caught with a staggering amount of graphic child abuse material.
Elizabeth Vale man Terry William Rincon, 48, pleaded guilty in the Adelaide District Court to possessing almost 800 videos and images of child exploitation material after police raided two northern suburbs homes in 2020.
The court heard that on August 9, 2020, Rincon used the mobile app Telegram to facilitate separate online chat conversations with two users who went under the aliases “Super 158” and “Intel Phoenix Gang”.
During those conversations, Rincon sent a video file featuring graphic material of pre-pubescent girls, followed by another twisted video to both users two days later.
Police raided the two homes shortly after on August 12, finding 777 child exploration videos and images on several of Rincon’s devices including a smart phone and an iPad.
Rincon’s capture was part of a South Australia Joint Anti Child Exploitation Team operation and he was photographed outside court shortly after his arrest covered in sweat.
During sentencing, Judge Liesl Kudelka said Rincon deserved to be jailed for possessing the “depraved” material and sharing some of it with others.
“You were in possession of a significant quantity of files involving pre-pubescent children,” Judge Kudelka said.
“You transmitted some to others, which is a serious offence.
“The material you accessed, transmitted and possessed was perverse and depraved.”
The court heard Rincon had been a regular alcohol and cannabis user since he was 12-years-old and suffered a serious brain injury when he was attacked by a group of men in a hotel in 2012.
Rincon had surgery to reconstruct his jaw and face and sustained a traumatic brain injury to the frontal lobe as a result of the attack.
Judge Kudelka said there was no evidence to suggest Rincon’s intellectual functioning or psychological state affected his capacity in relation to the offending.
“You need to understand, and I do not think you do yet fully comprehend, that real children out there are sexually abused to create this material,” she said.
“It is a major international problem. The possession and transmission of child abuse material encourages the sexual exploitation of real children around the world, who are incapable of protecting themselves.”
Judge Kudelka sentenced Rincon to a total term of one year, 11 months and 25 days in jail.
With time served he will be eligible for release in seven months.
