A Windsor Gardens man is accused of causing children to perform sex acts on him, court documents have revealed.
Daniel Joseph Fitzgerald, 65, will remain in custody, charged with having unlawful sexual relationships with two children under the age of 14.
Fitzgerald denied the assistance of a duty solicitor in the Adelaide Magistrates Court on Thursday, charged with multiple child sex offences.
“You’re appearing in relation to some serious charges of a sexual assault nature … do you wish to apply for bail?” Magistrate Simon Smart asked Fitzgerald in court.
“No,” Fitzgerald replied.
Court documents revealed that at Windsor Gardens Fitzgerald allegedly maintained an unlawful sexual relationship with a person under the age of 14 years, by engaging in two or more unlawful sexual acts with her.
It is alleged that Fitzgerald caused the child to perform sexual acts on him on more than one occasion and caused another child to perform sexual acts on him in her presence.
The documents also revealed that Fitzgerald allegedly maintained an unlawful sexual relationship with another child under the age of 14, by causing her to perform sexual acts on him multiple times, as well as in the presence of another child.
Fitzgerald is also charged with communicating with the intention of procuring the second alleged victim, a person under the age of 17, to engage in or submit to sexual activity.
The charge is aggravated with it being alleged that Fitzgerald committed the offence knowing the child was under the age of 14.
Fitzgerald is charged with unlawful sexual intercourse with a person under 14 years for both alleged victims.
The maximum penalty for that charge is life imprisonment.
In the Adelaide Magistrates Court on Thursday, Fitzgerald’s charges were adjourned until June.
