Allegations a convicted drug dealer had begun trafficking drugs just months after his release from prison have been dropped, earning prosecutors a verbal lashing from a magistrate.
On Monday, Karl Martin Schiworski appeared in the Adelaide Magistrates Court to enter a plea to allegations of trafficking in a controlled drug.
However prosecutors announced in court that the charges had been dropped, which Magistrate Simon Smart said was “disgraceful” after the Craigmore man had been held in custody since June.
“Six months of someone's life has been taken away from them … I find it remarkable and rather shocking,” Mr Smart said.
“You asked originally for a date in February for charge determination, so he would have spent eight months in custody for the charges to be withdrawn.”
Mr Smart said that he had come across a number of cases where alleged offenders were remanded in custody for extended periods of time before charges were dropped by prosecution.
Schiworski had pleaded guilty to charges of being in possession of a prohibited weapon – a brass knuckle duster – in August.
Mr Smart said he was “more than satisfied” with sentencing Schiworski to time served.
