Defence lawyers for a South-East man accused of historic child sex abuse have hit back at the alleged victim and her sister who wanted to paint their stepdad as a “violent monster”.
During his closing address Prosecutor Gregory Dudzinski said the girl vidly remembered the bar of soap he would use while he abused her.
“It makes her feel sick to this day,” he said.
His defence lawyer Nick Healy, told the court though he does not believe the pair had “concocted” their entire testimony but added that there was inconsistency in their key evidence.
“Let me tell you something about conconcution and lying, it takes a very intelligent person to pull of a consistent lie — almost a narcissistic personality,” he said.
The man has not been charged in relation to the alleged acts of domestic violence and exercised his right to not take the stand in his own defence.
He has pleaded not guilty to one count of sexual abuse of a child.
Mr Healy said the alleged victim had falsely claimed her mother was subject to domestic violence weekly in a bid to paint his client as a monster.
“Paint a picture of a man who they were so terrified of (that) that’s why the ceded to his sexual demands,” he said.
The allegations regarding the defendants alleged sexual abuse first came to light in 2007, after the girl told her grandmother the man had poured beer over his penis and into her vagania, the court heard.
After speaking with police the alleged victim’s mother decided not to press charges, the court heard.
The alleged victim approached and spoke with police again in 2021 now that she’s an adult.
The court heard while watching TV in the lounge room the alleged victim was near her stepdad who was drinking.
“(She) doesn‘t remember all the steps up to what happened — but she remembers the accused pouring beer into her vagina,” Prosecutor Gregory Dudzinski said.
According to court documents the alleged abuse began when the girl was roughly five and occurred between 2004 and 2007.
Mr Dudzinski told Mount Gambier District Court the man’s abuse had committed a number of sexual acts, while in the shower.
The man would often guide the alleged victim’s hand to his penis when they showered together, which she would allegedly hold while he urinated, the court heard.
“As this became a much more normal, repeated occurrence — she would place her hand there without the physical intervention,” Mr Dudzinski said.
“The defendant would ask (the alleged victim) to hold his penis while he urinated — this again happened with some disturbing regularity.”
The court heard he would also abuse the girl while inside pillow and blanket forts he help erect.
Judge Geraldine Davison will give her final instructions to the jury on Friday before they begin their deliberation.
