An alleged rapist told a woman he didn’t want to go to jail and he’d buy her a car if she told police they were boyfriend and girlfriend, a court has heard.
John Kakule, 46, is standing trial in the Adelaide District Court after he said the sex they had was consensual “at all times”.
During the prosecution’s opening statement, the court heard alleged victim did not drive and relied on Mr Kakule and others to transport her around Mount Gambier.
The court heard Mr Kakule asked the woman regularly for sex and let her know of his sexual interest in her.
“(The alleged victim) made it clear to the accused on numerous occasions that she did not reciprocate the sexual interest and that she did not want to have sex with him,” the prosecutor said.
The court heard Mr Kakule drove the woman to an excluded area in 2019 and said “I planned to bring you here and I’m going to do it”.
“He then attempted to pull up her skirt, leggings and her underwear,” the prosecutor said.
“He restrained her while he was doing this, pushing her down so she was unable to move.”
The court heard the woman tried to call triple-0 but Mr Kakule grabbed her phone and threw it in the back of the car.
He apologised to her and said he’d never do it again.
The court heard a couple of days later Mr Kakule and the woman were at his house, when he allegedly raped her three times.
The prosecutor said the woman was initially able to crawl under the table to get away from him but Mr Kakule laid on top on her and pulled her dress and her underwear down.
The court heard Mr Kakule called the woman after the alleged rape and said something similar to “I’m sorry, forgive me”.
“He told her he didn’t want to go to jail and he offered to buy her a car and teach her to drive if she told the police that they were boyfriend and girlfriend,” the prosecutor said.
The court heard when Mr Kakule was interviewed he told police it was the woman who made the first sexual advances towards him and he returned them.
Mr Kakule, of Worrolong, has pleaded not guilty to assault with intent to rape and three counts of rape.
Carrie Demertzis, for Mr Kakule, told the court there was no dispute Mr Kakule and the woman had sex but it was consensual “at all times”.
The trial before a jury continues.
