A fourth man has been charged over the alleged gang rape of a teen girl, who found one of her alleged rapists via social media.
A 24 year-old South-East man, who was arrested in Naracoorte, appeared in the Mount Gambier Magistrates Court for the first time on Thursday, charged with multiple counts of unlawful sexual intercourse.
A suppression order was made against one of the co-accused meaning neither him or any of the men charged can be legally named.
Acting as the 24-year-old’s defence lawyer, Tess Dunsford asked the court for a home detention report to be ordered to see if her client was eligible for bail.
Magistrate Koula Kossiavelos said she would order the report and hear further arguments from both prosecutors and Ms Dunsford later this month.
However, Ms Kossiavelos said this did not mean that she would grant the accused bail.
A 27-year-old Salisbury man, a 22-year-old Bordertown man and a 22-year-old Victorian man were arrested on June 24 after filming their alleged assault.
The Port Adelaide Magistrate Court previously heard the 18-year-old alleged victim was out clubbing with a friend at Zhivago, before allegedly blacking out and ultimately waking up to men on top of her.
“The victim had consumed a large amount of alcohol … she recalls vomiting in a pot plant while her friend had got into an altercation with some males,” the police prosecutor said.
“She doesn’t recall leaving the city … the next thing she remembers is being on a bed in an unknown house with males standing around her.”
The court also heard the alleged victim had found one of the men on Instagram, messaging him saying she needed the address as she had left belongings at the home.
She then allegedly used the provided address to give to police.
The court heard one male allegedly pushed the alleged victim’s head into his penis before slapping her.
“One male asked if she wanted sex and she said no but he did not listen,” the police prosecutor said.
“She recalls only three men having sex with her however there were multiple used condoms on the floor of the room the next day and she recalled the home as a shared one.
“Her mother started messaging her and she asked one of the co-accused to drop her home.”
The court heard the Bordertown man dropped the victim home before she told her mother what had happened.
The court heard police attended the alleged victim’s home and seized clothing from the night.
A semen match from the alleged victim’s dress matched the Bordertown man’s DNA, the court was told.
His phone was seized and police allege a video filmed by the defendant showed him and the other co-accused having sex with the victim.
All four men are currently in custody on remand, with only one pending bail application.
